Airbnb & Breach of Leases

In the last few years, many leaseholders have been in breach of their leases by renting their properties inside the Curnock Street Estate for a few days at a time. As you can see from the article below, this is not allowed in council properties:

How does this behaviour affect the residents?

There are many reasons why the daily rental of flats is unsuitable for social housing estates. There is the legal part and the community impact (noise, Health & Safety, etc).

  • Multiple breaches of the leases
    • Short-let (section 3.16). Lewi Neda’s solicitors confirmed that flats cannot be used for commercial purposes, such as a hotel.
    • Deeds of Covenants (Section 3.24′) Short-lets are not signing the deeds, which is a breach of the lease. The warning for leaseholders is shown in the Camden Account.
    • HMO – More people staying in properties than the number specified on the HMOs
    • Unauthorized alterations (section 3.14 ) – Some of those properties have unauthorised alterations which are in breach of the lease
    • Noise nuisance (Section 3.18),
    • Fire Risks (Section 3.13), lack of Health and safety, etc
    • Fake profiles and names as hosts
    • There has been a compromise on the building insurance, which is for residential purposes only and not for commercial or business use. An investigation is in progress with Arthur J Gallanger.
    • Lack of consistency in the council’s services and responses (Ref: planning and other departments)

For example, this flat had and probably still has a gas heater on its patio under the trees. This is a fire hazard, and we are not sure who maintains that heater or if it is safe when drunk people are on that patio during regular parties. Camden Council regulations do not allow this.

At the same time, they installed a jacuzzi on their patio, which included electrical cables and plugs. This allowed their guests to have hen parties via lockdowns, which continued until the early hours of working days.

We had to call the noise patrol many times. Elderly and ill residents suffered for one non-living landlord to make excessive profits.
